Modern life is extremely complicated and governed by numerous rules, laws and regulations. People no longer make agreements by making a pledge and shaking hands on it. That type of trust simply does not exist any longer. Instead, every modern agreement is clothed in complicated legal terminology and has to be signed, witnessed, notarized, filed and often even served. Notaries have their origin in ancient Rome where scribes slowly but surely began to take on more responsibilities. Appointments are sometimes on a permanent basis but often for a limited period only with an option to renew.

Notaries have to make sure that their clients understand that a false oath can lead to criminal charges.

In some other cases the court will require a deposition when a witness is unable to appear in court personally in order to testify. Depositions can be lengthy and that is why some notaries are also stenographers.

An increasing number of people use notaries to certify that a specific deal or arrangement has been agreed to and that both parties agree to the terms and conditions. Notarised agreements carry much more weight than agreements simply signed by the parties concerned. Then there are even notaries that are licensed to perform wedding ceremonies on condition that the couple getting married has already obtained a marriage license.

One of the most interesting duties of notaries is to certify that a specific act or event has indeed taken place. A court may, for example, instruct someone to perform a specific act such as repairing his fence and a notary will then certify that this was indeed done. The Guinness Book of World Records use notaries to certify that an attempt on a record has indeed been made and that all the rules have been followed to the letter.

Every task performed by notaries has to be recorded. The format of these records is prescribed by law and differs from one country to the next. These records are very important because they constitute prove that a specific agreement has been made, that a particular oath has been administered or that a specific event has occurred. The very existence of these records are often enough to prevent disputes.

Notaries play an important role in making sure that procedures are followed, that agreements are legal, that transactions are fair and that justice is served. Their reputations are such that their word in a matter is often considered to be the final one. They are part of the everyday lives of everyone.
